General terms and conditions of sale for on-line or distance purchases

GENERAL CONDITIONS
These general terms and conditions of sale are governed by the Consumer Code (Legislative Decree no. 206/2005 and subsequent amendments and additions) and by the rules on e-commerce (Legislative Decree no. 70/2003 and subsequent amendments and additions) and apply exclusively to distance and/or web sales - on the website www.piastrellerinaldi.it - of the Products and Services of Rinaldi S.r.l..
Confirmation of acknowledgement and acceptance and/or selection of the "Place order" button by the purchaser implies unreserved acceptance of these general terms and conditions of sale, which shall prevail over all previous or specific versions generated by the purchaser, including the exchange of e-mails.
The General Conditions published on the Site at the time the Order is sent by the customer and/or transmitted for acceptance at the time the contract is concluded shall apply to the purchase order.
PRODUCT OFFERING
All information on product offers presented on www.piastrellerinaldi.it is valid within the limits of available stocks and subject to availability from suppliers. The products are presented as accurately as possible. For each product, the price, product characteristics, and weight of each purchasable unit are indicated in the electronic catalogue. In the case of floor and wall tiles, both the weight and the price refer to 1 box of product; in the same case, the price is also expressed per SQM.
Before concluding the purchase contract, the customer shall examine the characteristics of the goods described by the sales staff of Rinaldi Srl or in the individual product sheets available on the Site. The seller reserves the right to change these descriptions at any time without notice, it being understood that such changes shall not affect orders already accepted.
PRODUCT PRICES
All prices of the Products shown on the Site are in Euro, and include VAT.
The costs relating to the Services made available by Rinaldi S.r.l., as set out in the following articles of these General Terms and Conditions, are at
borne by the Customer and adequately detailed in the Purchase Order.
Products and services shall be subject to the Price shown on the Site at the time the order is placed, or within the "Customer Order" concluded, without any consideration of previous offers or any changes in Price occurring subsequently.
The prices displayed on www.piastrellerinaldi.it or formulated in remote sales are only valid for online purchase - at a distance, and may differ from those charged at our locations and showrooms.
DELIVERY CHARGES
The cost of transport will be calculated automatically according to the weight and volume of the articles making up the order, as well as the destination location. In any case, the amount of shipping costs shall be shown in the final summary/Customer Order, BEFORE the actual conclusion of the purchase procedure and conclusion of the contract. Unless otherwise agreed in writing, payment must be made at the same time as the order by bank transfer or credit/debit card or Satispay or Paypal.
CHAMPIONS
To assist in the choice of the desired product, through the online/distance purchase procedure it is possible to request a free sample (with the sole charge of shipping costs) of Rinaldi Srl tiles and parquet floors: the cost of such shipment is calculated according to the weight of the sample. Should the sample be requested together with other products, Rinaldi Srl reserves the right to cancel the order placed, given the different purchase conditions envisaged for the two product categories. Since the sample is free of charge, Rinaldi S.r.l. shall not replace it in the event of damage to the same.
ORDER (Website Purchase Procedure)
a) To conclude the purchase contract on www.piastrellerinaldi.it it is necessary to fill in the electronic Order Form of Rinaldi S.r.l., by following
the following procedure:
- Go to the product you want.
- Select the quantity you wish to purchase. In the case of tiles, parquet or mosaics, we always advise you to purchase in approximate quantities,
at least one 10% more material than the actual surface area, the type of installation chosen or the need to cut more than is
been calculated. - If in doubt, please contact us on 0173/75335.
- Add to cart; if you have completed your purchase, you can confirm the items in your cart, or otherwise you can continue the
shopping by choosing to add other items to the shopping cart. - Once you have confirmed your cart, you must add your billing details (specifying whether you are buying as a private individual or as a company) and the
shipment (there is the possibility of requesting that the products be sent to an address other than the billing address). - In the purchasing process, the cost of shipping is always quantified and calculated according to the weight and volume of the
products. - Choose your means of payment; we accept bank transfer, credit/debit card payment via BCC-Sinergia and
payment via PayPal or Satispay.
b) The contract shall be deemed to be concluded between Rinaldi S.r.l. and the Customer upon receipt of the Order by Rinaldi S.r.l. and the relevant
payment.
In this case, Rinaldi S.r.l. shall acknowledge receipt of the Order by sending an order confirmation e-mail to the e-mail address provided by the Customer.
Such Confirmation shall summarise the Products and Services selected, the relevant Prices (including Delivery Charges and any additional Charges for additional Services requested by the Customer), the Customer's data, the billing address and the delivery address (if different from the billing address), if any, and any special Conditions applicable to the individual Order and determined following specific requests by the Customer.
Rinaldi S.r.l. reminds the Customer to verify with the utmost care and attention the correctness of the data contained in the Order Confirmation and to
communicate any corrections to Rinaldi S.r.l. within 24 (twenty-four) hours of receipt thereof.
The Order Number communicated by Rinaldi S.r.l. shall be used by the Customer in any communication with Rinaldi S.r.l..
It is possible that there may be occasional non-availability of the Products offered, in which case, if the Products chosen by the Customer are not, in whole or in part, available, Rinaldi S.r.l. reserves the right to notify the Customer within 24 (twenty-four) hours of receipt of the order.
In the possible but rare event that a product chosen by the purchaser is not available at the time of purchase, Rinaldi S.r.l. shall proceed to refund the payment or amount advanced.
By transmitting the order form electronically, the purchaser undertakes to observe all applicable General Terms and Conditions of Sale.
ORDER (Distance Purchase Procedure)
The contract between Rinaldi S.r.l. and the Customer shall be deemed to all intents and purposes concluded and binding between the Parties at the moment of acknowledgement - by the proposer - of the signing for acceptance of the Estimate - complete in all its essential elements - and/or of the Purchase Order, as well as of the agreed payment.
CANCELLATION OF ORDER
If Rinaldi S.r.l does not receive payment after 7 days from the time the order is placed, Rinaldi S.r.l reserves the right, subject to notification, to consider the order cancelled.
METHOD OF PAYMENT
Unless otherwise agreed in writing, payment of the Order shall be made at the same time as the Order itself is forwarded to Rinaldi S.r.l, or in the case of a bank transfer, within the aforementioned 7 days from the time the Order is forwarded.
Payment shall be made by bank transfer, credit/debit cards via the BCC-Sinergia banking circuit or via PayPal or via
Satispay.
- Bank transfer
In this case, the order will be processed from the next working day after receipt of payment. To speed up the deposit time, we recommend sending a copy of the CRO bank transfer. If we do not receive payment after 7 days after the order has been placed, we reserve the right, after prior notification, to consider the order cancelled. All information regarding payment by bank transfer will be sent by e-mail to the address indicated in the "Billing Details" section of the purchase procedure. - Credit/debit card
In case of authorisation of the BCC-Sinergia service of the credit/debit card transaction, the order will be processed from the next working day after the payment has been received. All order information will be sent by e-mail to the address you have indicated in the "Billing details" section of the purchase procedure.
BCC-Sinergia is a fast and secure payment gateway for online payments (the transaction and input data are fully monitored by the banking system) and you can use credit cards such as Visa and Mastercard.
For transaction security reasons, Rinaldi S.r.l. reserves the right to request a copy of an identity document of the Credit Card holder.
Rinaldi S.r.l. shall issue an invoice for the Purchase Order, sending it by e-mail to the person to whom the Order is addressed. In the event of non-receipt of the invoice, contact us at the following support number 0173/75335 or write to us at info@piastrellerinaldi.it.
For the issue of the invoice, the information provided by the Customer himself shall be considered authentic. Rinaldi S.r.l therefore reminds the Customer to always check, with the utmost care, the accuracy of the information provided.
In the event that the invoice holder wishes to benefit from tax concessions (reduced VAT at 4% or 10%), please tick the appropriate field in the Order Form, called "Invoicing Details". You will be contacted by one of our operators in order to request the necessary documentation to issue the invoice with the requested facilitation.
For the use of particular forms of payment, Rinaldi S.r.l. reserves the right to charge an additional fee due to any commission required.
SHIPPING AND DELIVERY TIMES
Shipping costs can be viewed by placing the product in the shopping cart: in the case of distance selling outside the website, shipping costs
are detailed within the estimate.
Rinaldi S.r.l. always sends an e-mail when goods leave its warehouses.
Rinaldi S.r.l. reserves the right to charge the customer for any storage and/or redelivery costs (further details can be found in the "delivery methods" section)
Rinaldi S.r.l. does not guarantee delivery service to all the islands of Campania, Tuscany, Sicily, Latium, Apulia, the
Sardinia, Venice, Livigno, as well as for the German islands.
Delivery times for ordered goods vary depending on the product and are approximate times, based on previous order statistics
processed: in any case, please note that Saturdays and Sundays are not considered working days for the purpose of calculating the estimated time frame.
Each product sheet shows delivery times, which are counted from the day following receipt of confirmation of payment for the goods, without any delays constituting grounds for withdrawal from the contract or giving rise to rights to compensation, except as provided for in Article 6 of Legislative Decree No. 185/1999. N. 185/1999. In the event that one or more of the products in the order are not immediately available, the order, even if paid, shall be processed when all the goods are available. The staff of Rinaldi S.r.l. shall in any case inform the customer of any delays in delivery times. Should the customer be interested in partial fulfilment of their order, please contact us at the following number 0173/75335: please note that this method could increase the overall shipping costs.
Shipping times for made-to-order products are linked to production, and may vary by a few days (down or up); production times for made-to-order products vary between 2 (two) and 7 (seven) weeks.
In the event that the Customer needs to receive the goods by a fixed date, and if the shipping time is decisive for the purchase decision, Rinaldi S.r.l. recommends contacting Customer Service (telephone 0173/75335) to check the relative timing with production.
Deliveries during the so-called 'peak' periods, i.e. before the Christmas and summer holidays, may be delayed even
considerable.
The on-line catalogue of Rinaldi S.r.l. is always up-to-date, it may rarely happen that a product is no longer available. In these cases Rinaldi S.r.l. shall notify the Customer who may request a refund of the amount paid or make changes to the Order.
In any event, Rinaldi S.r.l. is not able to guarantee that any reorders of sold-out lots can be processed, in which case it shall inform the consumer and refund any sums already paid, in the form and manner set out in art. 6 no. 2 of Legislative Decree no. 185/1999. N° 185/1999.
MODE OF DELIVERY
a) Direct withdrawal
It is possible to collect the goods in person, subject to telephone notice, from the Rinaldi S.r.l. warehouses located in: Via Langhe n° 4/A - Carrù (CN) phone: 0173/75335 and Strada Statale Alba - Bra, 186, Fraz. Cinzano - Santa Vittoria d'Alba (CN) phone: 0172/479304.
b) Shipping
Rinaldi S.r.l. shall deliver by specialised carriers specifically appointed by Rinaldi S.r.l.. The goods shall travel insured and with right of call. At the time of delivery, the presence of the Customer or of a trusted person is required to check that the packaging is intact and that the Products received correspond to the Order. In the event of visible defects, such as incorrect quantities and/or wrong Product and non-integral packaging, Rinaldi S.r.l. asks the Customer or a trusted person to report the aforesaid anomalies on the courier's transport document, in detail with the wording "GOODS SUBJECT TO CHECK FOR ... (e.g.: damaged, broken, dented, wet packaging, etc.)" and to contact Rinaldi S.r.l. by telephone on 0173/75335.
Rinaldi S.r.l. specifies that the goods will only be replaced if the transport document mentions the damage (it is also advisable to prove the
damage suffered through the acquisition of photographic images); Rinaldi S.r.l. asks the Customer for this attention because only through these
reports on the transport documents, Rinaldi S.r.l. may be reimbursed by the carriers and consequently will be able to replace the goods free of charge.
At the time the Order is placed, the estimated Delivery Date will be indicated. This date is purely indicative, therefore
no liability can be ascribed to Rinaldi S.r.l. in the event of failure to do so if Delivery is made within 30 days
from the Order (except customised work or products requiring longer production times).
Delivery is on the ground floor, in a place accessible by vehicle approx. 9m long, 2.5m wide, 2.9m high. Different requirements
must be agreed with Rinaldi srl. If a different delivery than the standard one is desired, a special request must be made in order to be able to reformulate the new cost estimate. Upon collection by the courier, an e-mail shall be sent to the Customer.
Subsequently, the Customer will be contacted directly by the Carrier to agree on the day on which the Delivery will be made and the relevant time slot.
time slot. In the event of the Customer's absence on the day and within the time slot indicated to the Carrier, Rinaldi S.r.l shall charge the Customer the cost of the new
Delivery.
In the event that:
- delivery is requested in areas where traffic is subject to restrictions and/or prohibitions, such as, but not limited to, traffic zones
limited, vehicle-restricted zones, pedestrian zones, etc; - the distance between the point of unloading and the destination property of the purchased Products is more than 50 (fifty) metres;
additional costs necessary for the above-mentioned additional services will be charged to the Customer.
In order to obtain all necessary information regarding the costs of such additional services, the Customer may contact Rinaldi S.r.l. before sending
the Purchase Order. After sending the Order, the Customer shall be required to contact Rinaldi S.r.l always through the above-mentioned channels of
contact, to promptly inform Rinaldi S.r.l of the need for the above-mentioned additional services and to proceed with the relevant payment to be made by bank transfer. Rinaldi S.r.l. informs all its Customers that in the event of failure to provide prior information about the need for the aforementioned additional services, Rinaldi S.r.l. may not be able to complete the delivery of the Products within the agreed timeframe and may also have to make a second delivery, which shall be fully charged to the Customer. Moreover, in the event of failure to provide prior information, Rinaldi S.r.l. reserves the right as of now to charge the Customer for all the relative costs for the additional services indicated above and not communicated in advance.
With regard to the aforementioned Delivery method, Rinaldi S.r.l shall be exonerated from any liability in the event of delays caused by events, acts, facts and circumstances unforeseeable at the time of the conclusion of the individual Purchase Contracts, unavoidable and also beyond the control of Rinaldi S.r.l (e.g. strikes, riots, natural disasters, etc.). In such situations, Rinaldi S.r.l. shall promptly notify the Customer of a new deadline within which it shall fulfil the Delivery and make every effort to fulfil all its obligations as set out in the Purchase Agreement.
LIMITS OF USE
The staff of Rinaldi S.r.l. work constantly to update the pages on the site. At the same time, the enormous amount of content developed makes it possible for any inaccuracies to exist. It is our daily responsibility to work towards ever greater precision and degree of thoroughness, but it is also the Customer's responsibility to ensure the truthfulness of the details that should be considered essential for their own satisfaction and necessary to proceed to purchase: as non-exhaustive examples the case of purchase of goods to complete products or collections already in possession (where the customer is required to check the matching and colour compatibility), goods with measurements slightly smaller than the space available (where the customer is required to contact us for a dimensional check of the product and possibly advice on the criteria for taking measurements in the environment) or even the rare case of any Product Sheets that should contain discordant information in different points of the sheet itself (the customer is required to read the entire Product Sheet); in the case of Product Sheets offering a "digital sample book" (i.e. images of finishes and colours), the Customer is required to observe the sample book carefully to assess how a certain "definition" in the Product Sheet with regard to materials translates in aesthetic terms into the Digital Sample and thus into reality. During the process of checking the Production Order Confirmations, in the days following the placing of the order on the portal, Rinaldi S.r.l. checks the correctness of the product prices. If, due to rare misunderstandings or inconveniences, the price indicated should turn out to be lower than the correct sale price, Rinaldi S.r.l. reserves the right to make up the difference or, if this is not possible, to contact the Customer to verify whether he/she still wishes to purchase the product at the correct price (otherwise the Order may not be accepted and any sums paid shall obviously be returned). All manufacturers and suppliers of Rinaldi S.r.l. work continuously to improve the products offered, therefore reserving the right to make technical and dimensional changes without prior notice if these changes do not significantly alter the aesthetic content of the products and their use/ergonomics. Rinaldi S.r.l. reserves the right to make changes to the names of some products or parts thereof in order to comply with any agreements with manufacturers. On some products presented without the publication of the production brand, product labels may therefore be applied bearing names different from those published by Rinaldi S.r.l.: these variations cannot in any way be a prerequisite for contractual termination due to "non-compliance" as the "product name" cannot be considered a fundamental element of the value offered to the consumer by the product itself. Any delays in delivery of less than 30 (thirty) days shall not entitle the Customer to refuse delivery of the products, nor to claim compensation or indemnity of any kind.
Special delivery terms and conditions shall be agreed in advance between the Customer and Rinaldi S.r.l. and accepted in writing by
Rinaldi S.r.l.
LIABILITY
Rinaldi S.r.l accepts no liability for disruptions in service due to force majeure such as accidents, explosions, fires, riots,
strikes and/or lockouts, earthquakes, floods, damage to computer systems, system crashes, and other similar events that prevent, in whole or in part, the execution of the contract within the agreed timeframe. Rinaldi S.r.l shall not be liable for any damages, losses and/or costs incurred as a result of the non-execution of the contract due to the aforementioned causes, the consumer only having the right to a refund of the price paid. Similarly, Rinaldi S.r.l shall not be liable for any fraudulent and illegal use of credit cards, cheques and other means of payment. Rinaldi S.r.l, in fact, at no time during the purchase procedure is it able to know the consumer's credit card number which, via a protected connection, is transmitted directly to the Bank managing the service.
GENETIC DEFECT OF PRODUCTS
Rinaldi S.r.l markets products of a high quality level, for which any warranty provided for by law is directly provided by the manufacturers, and the reference regulations as well as the methods for applying the warranty shall be those indicated and highlighted by the manufacturer together with the product.
PRODUCT GUARANTEES
The products are guaranteed against conformity defects and hidden defects in accordance with the conditions set out in the provisions of the Code of
consumption and the Civil Code.
Extracts from the Consumer Code:
Art. L. 211-4. The seller shall deliver goods in conformity with the contract and shall be liable for any lack of conformity that exists at the time of the
delivery. Similarly, he shall be liable for conformity defects resulting from packaging, assembly instructions or installation if it is his responsibility under the contract or was carried out under his responsibility.
Art. L. 211-5. To be in conformity with the contract, the good must: 1. be suitable for the use normally envisaged for similar goods and, as the case may be: correspond to the description given by the seller and possess the qualities that it has presented to the buyer in the form of a sample or model; present the qualities that a buyer can legitimately expect with respect to the public declarations made by the seller, the manufacturer or its representative, in this case in advertising or labelling; 2. either present the characteristics defined by mutual agreement between the parties, or be envisaged for any special use sought by the buyer, brought to the seller's knowledge and accepted by the latter.
Art. L. 211-12. The action resulting from the lack of conformity shall be time-barred for two years from the date of delivery of the goods.
RIGHT OF WITHDRAWAL
Sales of products via the Internet or remotely are governed by Legislative Decree no. 206/05 (arts. 50 to 68), which regulates the subject of distance contracts, i.e. made outside business premises. This legislation enshrines the right of withdrawal, i.e. the possibility for the consumer to return the purchased product and obtain reimbursement of the expense incurred, excluding return shipping costs. This right is reserved exclusively for natural persons (consumers, pursuant to Art. 3 of the Consumer Code), so it cannot be exercised by legal persons and natural persons acting for purposes relating to their professional activity, if any. In order to exercise the right of withdrawal, it is necessary to send, within 14 working days of receipt of the goods, a communication stating the wish to withdraw from the contract. The cost of returning the product shall be borne by the consumer.
The right of withdrawal lapses completely if the returned product is not intact, i.e:
- lack of original packaging or inadequate packaging;
- the product has been installed;
- absence of integral elements of the product (accessories, screws, components, etc.);
- damage to the product due to causes other than transport.
The right of withdrawal is also not exercisable if the product is not a prefabricated good but produced according to an individual choice of the
Consumer, finish, colour, size (the current wording of the law states that the right of withdrawal cannot be exercised for 'made-to-measure or clearly customised goods').
Lastly, the Right of Withdrawal does not apply to Customers who purchase for purposes inherent to their business activity (e.g.: instrumental use, resale, etc.) and who therefore inform Rinaldi S.r.l. of their VAT number.
PROCEDURE FOR EXERCISING THE RIGHT OF WITHDRAWAL
In the event that - having made a purchase on our site www.piastrellerinaldi.it or at a distance - you wish to withdraw from the purchase, you will need to follow this simple procedure:
- Send Rinaldi S.r.l, within 14 days of receipt of the goods, a communication by e-mail to info@piastrellerinaldi.it,
or by registered post with acknowledgement of receipt addressed to:

12061 Carrù (CN) - The Withdrawal Notice shall specify the wish to withdraw from the Purchase and the Product or Products for which it is intended
exercise the right. - Provide, within 14 (fourteen) days from the date on which the consumer communicated his decision to withdraw pursuant to
Article 52 of the above-mentioned Consumer Code, the shipment of the product carefully packed in its original packaging and
complete with all accessories, instruction manuals and everything originally contained, using a courier of your choice. - Insure the shipment against theft and transport damage and bear the costs thereof. The transport costs for the
Return of the Product(s) subject to Withdrawal are the responsibility of the Consumer and the Return is the full responsibility of the
Consumer himself. If the returned product has not been insured for the value indicated on the invoice, in the event of damage or loss
occurring during transport, Rinaldi S.r.l. reserves the right to charge any damages incurred by deducting them from the sums to be refunded. - Ship the product to the following address: Rinaldi S.r.l. - VIA LANGHE 4/A, 12061, CARRU', CN
- Once the Product has returned to our possession, if it meets the requirements necessary to exercise this right, Rinaldi S.r.l
shall proceed, by bank transfer, to reimburse only the cost of the goods shipped within 14 working days after the
return of the goods and in any case not before receipt of the goods. We therefore invite you to indicate your bank details and include
such information together with the returned goods.
CONDITIONS OF RETURN
Return shipping costs are always borne by the customer, who may return any item (except customised products
or easily perishable) in a substantially intact and correctly franked condition.
Subject to due documentation and notification, Rinaldi S.r.l. shall bear all costs in the event of defective or broken items delivered and shall replace them.
In the event that the order is not delivered on time due to reasons not attributable to us (e.g. incorrect address provided), the customer shall bear the return and storage costs, which shall be calculated on a case-by-case basis.
LEGAL AND CONVENTIONAL GUARANTEES
a) Legal guarantee for the Consumer Customer
The Consumer Customer, as defined in Article 3 of the Consumer Code, has the right to make use of the legal guarantee provided for in the Consumer Code.
Consumer itself. This Warranty provides, among other things, that the Consumer, under penalty of forfeiture, shall report to Rinaldi S.r.l any conformity defect found by the Consumer in the product purchased within 2 (two) months from its discovery. Any anomalies or damage (e.g. scratches, dents, etc.) must be reported to Rinaldi S.r.l within 8 (eight) days from delivery. Following such notification, the Consumer shall be entitled to request the repair, price reduction or replacement of the Product, without prejudice to the other rights provided for by law in favour of the Consumer. By virtue of the aforementioned legal warranty, Rinaldi S.r.l is liable for conformity defects that become apparent within 2 (two) years from Product delivery. Beyond this term, Rinaldi Sr.l, therefore, shall not be liable for conformity defects encountered by the Consumer. In the event of replacement or repair of the Product, the terms of the warranty relating to the Product given as replacement or resulting from the repair are the same as those of the original product. Therefore, the overall two-year duration of the legal guarantee shall in any case start from the delivery of the original product. In order to be able to benefit from the guarantee, we recommend that the Consumer shows the purchase document.
Damage caused by misuse of the Product(s) or incorrect or inaccurate assembly by the Customer is excluded from the Legal Warranty.
b) Legal guarantee for the non-consumer client (Professional)
The Professional Customer, as defined in Article 3 of the Consumer Code, has the right to make use of the Legal Warranty provided for in the Code
Civil Code. This Guarantee provides, inter alia, that the non-consumer Customer, under penalty of forfeiture, shall notify Rinaldi S.r.l. of any defect in
conformity found in the purchased product within 8 (eight) days from its discovery. The above-mentioned Legal Warranty is valid for a maximum term of 12 (twelve) months from Product delivery. Beyond this term, Rinaldi S.r.l., therefore, shall not be liable for conformity defects found by the non-Consumer Customer. In order to take advantage of the warranty, we recommend the Customer to show the purchase document.
APPLICABLE LAW AND JURISDICTION
These general conditions are governed by Italian law.
For any dispute concerning the interpretation, execution or termination of the sales contract, the court of the place of residence or domicile of the consumer shall have exclusive jurisdiction.
In the event of a Customer not falling within the above category, any dispute relating to this contract shall fall under the exclusive jurisdiction of the Court of Cuneo.

ONLINE DISPUTE RESOLUTION
The European Commission gives consumers the possibility to solve disputes online, according to Art. 14 Par. 1 of the Online Dispute
